                                                      RENTAL AGREEMENT 

This agreement has been produced to protect the interest of Chi Decor Party Rental, LLC and its clients. This document should be read, signed, and approved by the individual receiving the services provided by Chi Decor Party Rental, LLC. Preceding to signing this document, the representative from Chi Decor Party Rental, LLC should clarify the terms and conditions of the services rendered to the client. During this time, the representative from Chi Decor Party Rental, LLC should address any additional questions regarding the client's services. The client shall not sign the agreement if both parties have not developed a rapport with the service being rendered.

 

Responsibility and Use & Disclaimer Warranties: You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Chi Decor Party Rental, LLC harmless from and hereby release Chi Decor Party Rental, LLC from, all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Chi Decor Party Rental, LLC negligence, from the defective condition of the items, or any other cause. YOU AGREE THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED. 

Equipment Failure: You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair and will immediately (one hour or less) notify Chi Decor Party Rental, LLC of the facts. Chi Decor Party Rental, LLC agrees at our discretion to make the items operable in a reasonable time, or provide a like items if available, or make a like item available at another time, or adjust rental charges, the provision does not relieve renter from obligations of contract. In all events Chi Decor Party Rental, LLC shall not be responsible for injury or damage resulting in failure or defect of rented item.

Use of Equipment: Renter agrees & covenants to be satisfied with the instruction and condition of equipment rented and the proper and safe use equipment, or that renter is so familiar and conveyed to Chi Decor Party Rental, LLC you were. Renter further agrees that the items will only be used at the address listed on contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter agrees they have read all instruction manuals, operating instructions, and warnings related to rented items 

Equipment Responsibility: Renter is responsible for equipment from time of possession to time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, damaged, renter will assume cost of replacement or repair, including labor costs. Renter shall pay a reasonable cleaning charge for rented items returned dirty.

Time of Return: Renter's right of possession terminates upon the expiration of rental period set forth on the contract. Time is of the essence in this contract. Any extension must be agreed upon in writing. Under the rental policy, we specify the hours that Chi Decor Party Rental, LLC allows the lessee to utilize the equipment.

Late Returns: Renter shall return rented items to Chi Decor Party Rental, LLC during regular business hours, promptly upon. or prior to expiration of rental period. If renter does not timely return, the rental rate shall continue until items are returned. 

Payment: Renter shall pay all charges payable on this contract in advance, provided however that all forgoing shall not limit the amount of payable by renter hereunder and all additional amounts hereunder shall be paid immediately as such costs are incurred. Renter shall pay all reasonable costs of collections, court, and attorney fees. If rental charges are not paid within (10) days of the due date, Chi Decor Party Rental, LLC at our discretion may re-calculate rental charges on a daily basis. Renter shall pay in addition to any other amounts payable hereunder, a service charge 2.0 per month on all past due accounts. 

Deposit: Renter shall pay a 25% non-refundable deposit at time of reservation unless otherwise discussed with a Chi Decor Party Rental, LLC officer. The fee is 25% of the original rental order including delivery/pickup charges. Deposit will be forfeited if reservation is canceled at any time. If no deposit was taken, and customer agreed to terms of this contract, customer is still responsible for a 40% cancellation fee. If reservation is canceled within 5 days prior to scheduled "time and date out", renter will be charged a 50% cancellation/restocking fee of the original rental order. 

Additional charges: In addition to other charges and cost provided herein, renter shall pay charges in accordance with company rates then in effect for the following services. Delivery and/or Pick up to any location other than level ground. Set up of tables and chairs. Delivery and Pickup after business hours, Saturdays, Sundays, and Holidays. Packaging materials not returned. Service calls. Site survey and preparation. 

Delivery & Pickup: Renter shall clean and repackage (in original packaging) the rented items and if Chi Decor Party Rental, LLC agrees to pick up the item, renter shall make it available to Chi Decor Party Rental, LLC for pick up at a mutually agreed and convenient accessible location. Delivery and pickup shall be at the convenience of, and at the time designated by Chi Decor Party Rental, LLC. Renter agrees to pay a service charge for each extra delivery or pickup call required by Chi Decor Party Rentals. Renter shall make its personnel available at the time designed for pickup, to assist, and pickup of all items.

The rental could before the entire day and  picked up the next day. Special provision if discussed before services is rendered. 

We will NOT deliver orders under $50. If your event requires a same day delivery and pickup, there is a $250 rental minimum requirement. Delivery, setup & Pickup pricing could START $120. Delivery & pickup without setup starting as low as $80. Drop off services without setup is optional, starting at $50. Services are in addition to regular travel charges. This applies to all parks, forest preserves, beaches, lakefronts, school events, and any other events, in which, the items cannot be delivered the day before or picked up the day after. Pricing may increase based on distance and delivery/pickup time flexibility. 

This may NOT be your actual delivery pricing.

Factors that may increase your delivery charges include (but are not limited to the following):

  • The zip code of the destination

  •  Order size

  •  Requests for delivery inside a building and/or set up and tear down of items

  •  Stairs and/or loading docks and elevators

Residence: An additional fee will be imposed if the equipment needs to be carried past the main floor or 144 ft. square feet from the main entrance. This fee may vary between $15-$100 depending on how many flights of stairs the crew members will need to go up.

Exception:If there is a freight elevator or ramp that accommodates our dolly, this fee will be waived.​

There is a $450 rental minimum requirement for deliveries locations greater than 25 miles from us.

The invoice should include the following information to be valid:

  • Client's name

  • Email

  • Phone Number

  • Address of the location( for Delivery purposes only)

  • Quantity and description of the services being rendered

  • Date & time for delivery or pick up

  • A brief description of our rental and payment policies

  • Any accommodations or additional services

  • Commercial venue designated for events: If the event is held at a Banquet Hall, Loft, or any special event venue, we need to know the following information:

  • Does the venue require any special permits or insurance?

  • Does the venue have a freight elevator? If so, we need to be informed of any particular specifications regarding the elevator (if any).

  • What is the best entrance to the venue? Is it the rear, the alley, or the front of the venue? (We have a dolly, so if you could please tell us whether it would fit through the halls, we would appreciate that!)

  • Outside/Open Areas: Please provide us with any specific instructions needed for arriving at the location such as, any rerouting in the area, construction, blockage–anything that would make the delivery smother. If it is a park, please advise us of any restrictions or make the proper accommodations.

Rental Policy:

  • Under the rental policy, we specify the hours that Chi Decor Party Rental, LLC allows the lessee to utilize the equipment.

  • Delivery services- The rental is for the entire day and will be picked up the next day. Special provision if discussed before services is rendered.

Minimum Rental: 

  • A minimum of $100.00 per client is required to secure equipment rental with Chi Decor Party Rental, LLC. Anything less, the order could be refused.

  • Payment Policy:

  • We now accept the following forms of payment; Zelle, check, and credit cards (online processing or PayPal). Note, the client must provide a check three weeks before the event for processing. 

 If the preferred method utilized by the client is via credit card, the payment must be processed two days before the delivery date. However, cash can be provided by the client upon delivery. Reference the invoice for specific information in regards to the payment options

Care of Equipment: In addition to its other obligations hereunder, Renter shall: Pay a reasonable cleaning charge for items returned dirty. Protect the rented items from weather damage, breakage, unauthorized or improper use, theft, or loss while in possession of renter. 

Insurance: Renter shall maintain, at renter's expense, liability, property, and casualty insurance coverage in amount sufficient to fully protect Chi Decor Party Rental, LLC and its equipment against any and all claims, loss, or damage. In the event of loss or damage, you shall exercise, and shall empower us to exercise all your rights to obtain recovery under insurance and shall cooperate with Chi Decor Party Rental, LLC to obtain recovery. All insurance proceeds should be given or assigned to Chi Decor Party Rental, LLC 

Site Preparation: Renter agrees to have site cleaned and ready for delivery and installation or dismantled for pickup or the equipment and agrees to pay any additional charges for any delay incurred along with any labor charges resulting in renter's failure to do so. 

Permits & Licenses: Renter agrees prior to any installation of rental equipment including tents, to obtain at renters’ expense, any and all necessary permits and licenses and other consents. 

Subsurface Conditions: Renter agrees to obtain any locating of underground utilities before delivery of rented items. Renter also agrees to reimburse Chi Decor Party Rental, LLC for any additional costs incurred as a result of undisclosed or subsurface conditions. Chi Decor Party Rental, LLC is NOT responsible for any damage to underground sprinkler systems during tent and/or inflatable installations. It is the customer's responsibility to provide Chi Decor Party Rental, LLC with a sprinkler line layout to decrease the risk of damage to a sprinkler line. However, even with a line layout there are no guarantees. 

Linen Considerations:

  • Chi Decor Party Rental, LLC currently carries a limited amount of linen in inventory. 

  • Runners, table cloths, Napkins, Chair covers and sashes are owned directly by Chi Decor Party Rental. Any damages or difficult stains will be charged to customer account for total of item.

  • Chairs Covers: Chi Decor Party Rental, LLC currently only carries the following colored chair covers in inventory

  • White

  • Black

  • Ivory

  • Material specifications:

  • Tablecloths: Polyester

  • Chair covers: polyester & spandex

                               Personalization by Fab Design or Chi Decor:

  • Although we strive to be perfect, we are human and are not immune to the very occasional defect or quality issue. If there is a quality issue with your order, you may return it in new condition and its original packaging for a prompt exchange for the same item. Please understand that personalized items are uniquely created and cannot be accepted for return unless there is a manufacturing error or product defect. All refunds or exchanges must be made within 5 days of receipt.

  • Review your personalization and order details before submitting your order. Check spelling, dates, and names carefully. Understandably, we cannot accept cancellations or changes to orders once they are placed, as they are immediately sent into production. NOTE: Chi Decor Party Rental, LLC also reserves the right to cancel your order at its discretion should the order be deemed inappropriate for language, content, or material.

  • Understandably, no refunds can be issued for orders delayed due to adverse weather conditions or any other unavoidable acts of nature. Thank you for understanding.​

Party-in Box: Chi Decor Policy: Because of the nature of these items, unless they have arrived damaged or defective, we cannot accept returns for Custom or personalized items. Customer should check spelling, dates, and names carefully before submitting. Understandably, we cannot accept cancellations or changes to orders once they are printed. Chi Decor will contact you prior to printing via email for final approval. If approval is not received within 24 hours, Chi Decor will print and customer will incur any additional fees for corrections.  

Items that were not included in bundle will be for the same quantity of said bundle. If you wish to increase bundle party size, minimum increments of 5. Increment number should be included in comment section.

Cake (6 or 9 inch) or Cupcake orders are basic (No Writing), customer must provide cake or cupcake topper for decoration.

Bakeries around Chicagoland will be utilized. If you dislike a particular bakery, please provide in comment section.

Cancellation Policy-Party-In-Box

  • 60% of the party package is due if cancellation occurs three week prior to event

  • 100% of the party package is due if cancellation occurs two days prior to the event

  • Any and all PERSONALIZATION PARTY FAVORS are non-refundable.

  • Any and all sweet tables items ordered is non-refundable.

  • Any and all Cupcake or Cakes order is non-refundable if cancelled occurs three week prior to event

Customer should be aware of any allergy their attendees might have. Chi Decor will not be held liable for customer error. 

​NOTE: Chi Decor Party Rental, LLC also reserves the right to cancel your order at its discretion should the order be deemed inappropriate for language, content, or material.​

Balloon Decor:Colors can/will differ from inspiration photos due to lighting.  A photo will be sent prior to customization. The client will have 8 hours to respond to photo. If client fail to provide feedback on color choice, Decor will assume the color options are acceptable. A  fee will be impose if after 8 hours client changes their mind on color options.

Damages: If the equipment is lost or damaged (including linen) and affects the presentation or functionality of the item, Chi Decor Party Rental, LLC has the right to penalize the client. Chi Decor Party Rental, LLC may penalize the client for partial value or, in most cases, the total value of the lost or damaged item. The client will be required to provide their credit card information (which will be on file for our protection).

Hold Harmless Agreement: Renter agrees all risk and agrees to hold Chi Decor Party Rental, LLC and any of its staff harmless from and against all claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly at or relating to; The delivery, loading, unloading, erection, installation, dismantling, and use of rented equipment. Contact of underground utilities, pipes, or any condition on renter's property. All necessary surface repairs. Any injury or damage during the use of rented equipment including but not limited to inflatables, dunk tanks, and any interactive games. 

Damage Waiver: If you agree to the damage waiver charge as specified, subject to the limitations and exclusions below,Chi Decor Party Rental, LLC agrees to modify the terms of this contract and relieve you of liability for accidental damage to the rented item(s) on this contract, and for loss due to fire, collision, windstorm, upset, riot. We exclude from this waiver, however, any loss or damage due to theft, misuse, or abuse, by conversion, intentional damage, mysterious disappearance, or other loss due to your failure to care for the rented item(s). 

Store credit: If a client postpones the event date (written), a store credit receipt will be issued. The client is eligible to utilize the store credit receipt 180 days from the date of receipt. The client needs to provide proof of the store credit receipt and or email to validate it. If after 180 days client forfiet any deposit returns or full payment.

Cancellation Policy:

  • Any and all sweet tables items ordered is non-refundable.

 

                       Appropriate Conduct/ Safe Working EnvironmentHealth & Safety:

Client(s) further understand that Chi Décor Party Rental, LLC complies with all health and safety laws, directives, and rules and regulations. Client(s) expressly agree(s) that during the [event/wedding/session] Client(s) and Client(s)’ agents shall not carry weapons or firearms, be exposed to severe illness, or request the [Provider] to do anything illegal or unsafe. Further, Chi Décor Party Rental, LLC will not provide services in any location or area deemed to be unsafe in its sole discretion, including, but not limited to, areas affected by communicable diseases, quarantined areas, or other similar occurrences. Under any of these circumstances, Chi Décor Party Rental, LLC reserves the right to end service coverage immediately and/or leave the [event/wedding/session]. Chi Décor Party Rental, LLC shall be entitled to retain all monies paid and Client(s) agree to relieve and hold Chi Décor Party Rental, LLC harmless as a result of incomplete event coverage, or for a lapse in the quality of the Chi Décor Party Rental, LLC work.

 

        Returned Checks: There will be a $50.00 charge on any returned check for any reason.
